Purpose
Landesp provides assistance services for people preparing to arrive in Spain or already living there. Depending on the plan, services may include an initial needs assessment, documentation assistance and coordination, support with administrative procedures, housing search and assistance, coordination with external professionals, support with registrations and insurance, process follow-up, access to tools or guides, and other services expressly included in the contracted plan.
Contracting one plan does not automatically include every service Landesp offers.
Pre-contractual information
Before contracting, you will receive sufficient information about the main features of the service, what is included and excluded, the price, possible additional costs, the payment method and schedule, the estimated timeframe, cancellation terms, the right of withdrawal where applicable, and whether third-party intervention is needed.
The particular terms, quote or plan description you accept form part of the contract. If these general terms conflict with expressly accepted particular terms, the latter prevail to the extent legally valid.
Price and payment method
Prices published by Landesp include VAT.
Payment is made in full at the time of contracting, through our payment gateway (Stripe).
Administrative fees, external professionals' fees, certified translations, apostilles, certificates, insurance, notary and registry costs, rent, deposits and any payment made directly to third parties are excluded from Landesp's price unless expressly included in the accepted offer. When electronic contracting involves a payment obligation, the final step of the process will clearly identify that confirming implies that obligation.
Formation of the contract
The contract is formed once you select or accept the plan or proposal, provide the necessary data, accept these terms, and complete payment or a payment commitment where applicable. Landesp will send you confirmation of the contract on a durable medium.
Start and execution of the service
The service begins according to the date or conditions communicated to the client. Timeframes shown for authorities, appointments, housing, providers or third parties are estimates unless expressly stated otherwise.
Certain actions depend on the client submitting documentation, appointment availability, and the actions of authorities, consulates, external professionals, landlords or banks. Delay attributable to these third parties does not by itself constitute a breach by Landesp.
Client obligations
- Provide accurate and complete information.
- Deliver the necessary documentation within the agreed deadlines.
- Report relevant changes to their situation.
- Review documents requiring their approval.
- Attend in-person appointments when mandatory.
- Pay the fees and third-party costs that fall to them.
- Meet deadlines that may affect their case.
Landesp is not liable for consequences arising from false, incomplete or late information provided by the client, unless the law provides otherwise.
Public authorities and results subject to third parties
The final decision on any procedure always rests with the competent authority. Landesp does not guarantee the granting of a visa, residence authorisation, NIE or TIE, nationality, degree recognition, appointment availability, acceptance of documentation, the outcome of an appeal, or resolution within a specific timeframe.
This limitation does not affect Landesp's obligation to properly perform the coordination service the client has contracted.
Collaborating professionals and third parties
Certain services may require lawyers, tax advisors, translators, real estate agencies, insurers or administrative agents. When a service is provided directly by an independent third party, the client will be informed before becoming bound, where applicable. In particular, individualised legal work may be carried out by a duly qualified collaborating lawyer or law firm.
Housing
When Landesp assists with a housing search, the service may include search, filtering, coordination, viewings, document assistance or negotiation within the contracted scope. The lease or purchase contract is entered into with the landlord, agency or relevant third party, unless expressly stated otherwise. Landesp does not guarantee that a landlord will accept a given application or that a property will remain available.
Right of withdrawal
If you are legally a consumer and the contract was concluded remotely, you generally have 14 calendar days from the conclusion of the contract to withdraw without giving reasons, unless a legal exception applies.
You may communicate withdrawal through an unambiguous statement sent to the contracting email indicated in these terms, or by using the withdrawal form included at the end of this document.
Starting the service during the withdrawal period
If you expressly request that Landesp start providing the service before the 14 calendar days have elapsed, and you later withdraw before the service is completed, you may owe payment for the part actually provided up to the time of withdrawal, on the terms provided by law. If the service is fully performed within that period, you lose your right of withdrawal only if the legal requirements of express consent and prior knowledge of that loss are met.
Cancellations after the withdrawal period
The commercial cancellation policy applicable once the legal withdrawal period has ended will be stated in the quote or proposal accepted by the client, and will in all cases respect mandatory consumer protection law.
Refunds
Where a refund is legally or contractually due, it will be made in accordance with applicable law and, as a general rule when arising from a valid withdrawal, using the same payment method originally used, unless legally permitted otherwise.
Complaints
You can submit enquiries or complaints to the email indicated in these terms. Landesp will try to respond within a reasonable time. When a complaint filed directly by a consumer cannot be resolved, Landesp will provide the legally required information about the accredited consumer ADR body with jurisdiction.
Changes to these terms
Landesp may update these terms due to regulatory, operational or commercial changes. New terms will not retroactively alter contracts already concluded, unless the law or a valid agreement allows otherwise.
Governing law and jurisdiction
These terms are governed by Spanish law. If you are a consumer, any judicial dispute will be resolved by the courts with jurisdiction under mandatory consumer protection rules. Nothing in these terms constitutes a waiver of the forum legally available to you.
